The act was created with the objective of regulating conditions of service of sales promotion employees in certain establishments. In the initial stages, the act applied to only pharmaceutical industry. However, the Ministry of Labour & Employment has expanded the scope of its applicability and the act now applies to numerous industries.

Any Person (Including Apprentice) employed or engaged for Hire or Reward to do any work relating to promotion of Sales or Business or Both is called a Sales Promotion Employee. There are few exceptions to this definition within the Act.

Every such employee must be given an appointment letter (in the prescribed format) from employer on date of appointment.
