Contract Labour (Regulation & Abolition) Act, 1970
This Act is to regulate the employment of contract labour in certain establishments, provide for abolition of contract labour in certain circumstances, and for other connected matters. Central and State Rules are made to ensure effective administration and monitoring of the Act.
Applicability:
- It extends to the whole of India and applies to every establishment or every contractor who employs or employed workers exceeding state specific threshold limit - on any day of the preceding 12 months as contract labour registration is mandatory to employ contract labour.
- The contractor has to prepare and maintain all the applicable compliance registers as stipulated under the Central and State Rules.
- The principal employer is primarily liable to ensure if the contractor has prepared and maintained all the required compliance registers, or else the end liability would fall upon the principal employer.
- The contractor and principal employer both has to file certain returns to the controlling authority within the due dates at prescribed intervals.
